Terms of Service

1. Acceptance of Terms

By accessing or using the StreamClick platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and StreamClick.

2. Definitions

• "Advertiser": A user who creates Campaigns and funds Bounty Pools to promote products or services.
• "Creator": A user who joins Campaigns to create content and earn rewards.
• "Campaign": A marketing initiative created by an Advertiser with specific requirements and budget.
• "Bounty Pool": The budget allocated by an Advertiser for a specific Campaign.

3. Eligibility & Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use StreamClick. By creating an account, you represent that you have the legal capacity to enter into this agreement.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Responsibilities

You agree to:

• Provide accurate and current information.
• Comply with all applicable laws and regulations.
• Not use the Service for any illegal or unauthorized purpose.
• Not attempt to reverse engineer, hack, or compromise the Service.

5. Platform Usage Rules

For Advertisers

You represent that you have the right to promote the products or services in your Campaigns. We reserve the right to reject any Campaign that violates our policies (e.g., illegal products, hate speech).

For Creators

You agree to produce original content that meets the Campaign requirements. You grant StreamClick and the relevant Advertiser a non-exclusive, worldwide license to use, display, and distribute your submitted content for the purpose of the Campaign.

6. Payments, Fees, and Refunds

Fees

StreamClick charges a service fee on payouts to Creators. This structure is subject to change. See the payout menu on the dashboard for current rates.

Payouts

Payouts are processed via Stripe Connect. You must have a valid Stripe account to receive funds. Payouts are subject to a clearance period to verify traffic quality and prevent fraud.

Refunds

Advertiser funds committed to a Bounty Pool are generally non-refundable once the Campaign is active and Creators have joined. Refunds for unspent budget may be requested upon Campaign termination, subject to a processing fee.

7. Intellectual Property

The StreamClick platform, including its code, design, and content, is the property of StreamClick and is protected by copyright laws.

Creators retain ownership of their content but grant the licenses specified in Section 5.

8. Prohibited Activities

The following are strictly prohibited:

• Fraud: Using bots, click-farms, or fake engagement to inflate metrics.
• Abuse: Harassment, hate speech, or offensive content.
• Illegal Content: Promoting illegal goods, services, or scams.

Violation of these rules will result in immediate account suspension and forfeiture of funds.

9. Suspension & Termination

We may suspend or terminate your account at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM USE OF THE SERVICE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STREAMCLICK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO STREAMCLICK IN THE PAST 12 MONTHS.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

13. Modifications

We reserve the right to modify these Terms at any time. We will provide notice of significant changes. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

14. Financial Terms: Credits vs. Currency

14.1 Virtual Nature of Credits
"Credits" on the StreamClick platform are virtual tokens used solely for the exchange of services within our ecosystem. Credits have no monetary value outside of the Service and cannot be exchanged for fiat currency except through our specific Creator Payout process.

14.2 Not a Bank
StreamClick is not a bank, money transmitter, or Money Services Business (MSB). Balances held in your account represent a limited license to use our Service, not a deposit account. We do not pay interest on balances.
